Summary of minutes

1. Discussion on issues for reforming the Civil Code (law of obligations)

Members discussed issues for reforming the Civil Code (law of obligations) based on Material No.27 and No.28.  Concrete issues discussed are as follows.

1 Mental reservation

2 Fictious manifestation of intention

3 Mistakes

4 Fraud and duress

 

Among issues discussed, the method of provisions to protect third parties (Material No.27, Part 3, 1(2), 2(1), 3(6), and Material No.29, Part (3)) would be discussed in the sectional committee to supplement deliberation.

     Among issues listed in Material No.29, issues after “Part I, 2 Expansion of provisions on manifestation of intention” will be discussed later.

 

2. Reported matters

The official name and selection of members for the supplementary sectional committees (tentative), which were left to the Chair at the 30th meeting, were reported as follows:

Official name: the 1st sectional committee, the 2nd sectional committee, and the 3rd sectional committee

Members: As listed in Organization of Members of Sectional Committees.
