Summary of minutes

1.  Discussion on issues for reforming the Civil Code (law of obligations)

Members discussed issues for reforming the Civil Code (law of obligations) based on Material No.29 (distributed at the 31st meeting). Concrete issues discussed are as follows.

  1 Manifestation of intention

Expanding provisions on manifestation of intention, and arrival of and ability to receive manifestation of intention

  2 Invalidity and rescission

Relative invalidity (invalidity which is equivalent to rescission), partial invalidity, and effect of a juridical act which is void.

 

   Among issues listed in Material No.29, the following issues were left to later meetings:

     Among “Arrival of and ability to receive manifestation of intention,” “When acceptance of manifestation of intention is constructed” (Material No.29, No.1, 3(3)).

     Among “Effect of juridical acts which is void,” “Scope of the right to claim return” (Material No.29, No.2, 3(2)).

   Among issues listed in Material No.29, items after “Ratification of acts which is rescindable” (No.2, 4), and issues listed in Material No.30 were left to later meetings.
