Summary of minutes

1  Discussion on issues for reforming the Civil Code (law of obligations)

   Members discussed issues for reforming the Civil Code (law of obligations) based on Material No. 36 (distributed at the 41st meeting). Concrete issues discussed are as follows.

     ・ Claims and obligations of multiple parties.

 

  Among issues for deliberation, the following issues were left to sectional meetings for supplementary discussion:

       Effect of the causes accruing with regard to one of the joint and several obligees  (Material No.36, Part I, 1(2)(c))

       Provisions same as joint and several obligation (Material No.36, Part I, 1(3)(b))

       Effect of the causes accruing with regard to one of the indivisible obligees (Material No.36, Part I, 2(2)(c))

       Provisions same as indivisible claim (Material No.36, Part I, 2(3)(b))

 

  Among the issues for deliberation listed in Material No.36 “Part II Guarantee Obligation” and the issues listed in Material No.37 were left to later meetings.

 

2  Report

    The result of study called “Research study on the system of guarantees and its practice in foreign countries” which was commissioned by the Ministry of Justice was reported.

    The schedule of the second meeting of the Second Sectional Meeting was announced. The Chair reported that the issues which were decided to left to sectional meetings for supplementary discussion would be deliberated at the First Sectional Meeting.
