Proper Operation of the Certification System for Private Dispute Resolution Business

Alternative Dispute Resolution (ADR) makes it possible for disputes to be settled flexibly by respecting the voluntary will of the parties and utilizing the knowledge of experts in various fields. Taking into consideration that society is becoming more advanced, complicated, and diverse, it is highly recommended that efforts be made to enhance and activate ADR in addition to improving the function of adjudication.

The Act for Promotion of Use of Alternative Dispute Resolution, which was enacted as part of justice system reform and has been in force since April 2007, provides for the responsibilities of the government to provide relevant information and a certification system by the Minister of Justice for private dispute resolution business, in order to promote the use of ADR.

It is necessary to operate the certification system smoothly and properly and to publicize the system so that people may understand the system fully and utilize the certified dispute resolution services as a user-friendly method of dispute resolution. The Ministry of Justice is ready to take various measures to ensure that the certification system will firmly take root.
