Discussion on individual issues relating to the Civil Code (law of obligations) reform

Summary of minutes

Members discussed on the following individual items relating to the Civil Code (law of obligations) reform.

1. General provisions on juridical acts
Necessity to review the rules on effects of juridical acts (necessity to stipulate the meaning of juridical acts, etc.).
Necessity to review the rules on manifestation of intent which conflicts with the provisions of the Act on the General Rules Relating to the Application of Law.
Necessity to review the rules in cases where there is a custom which contradicts with the default rules.
Other issues to be discussed, and directions and points to remember for deliberation, etc.

2. Mental capacity
Necessity to stipulate provisions on mental capacity (requirements and effects).
Other issues to be discussed, and directions and points to remember for deliberation, etc.

3. Manifestation of intention
Necessity to review the provisions on manifestation of intention (mental reservation, fictious manifestation of intention, mistakes, fraud, and duress).
Necessity to expand provisions on manifestation of intention (misrepresentation, and failure to give notice on disadvantagious facts, etc.).
Necessity to review provisions on arrival of and capacity to receive manifestation of intention (especially in cases where manifestation of intention is refused to receive).
Other issues to be discussed, and directions and points to remember for deliberation, etc.
