Summary of minutes

1. Method for conducting deliberation

The secretariat explained that the result of the public comments for the interim report of points at issue would be reported around November, 2011.  Based on this, the members agreed that they started the second stage of deliberation from this meeting but they might come back to these issues discussed before the report of the public comments as necessary.

 

The members agreed that the target period to conclude the interim report of the second stage of deliberation would be by February 2013.

 

The members discussed the method for conducting deliberation based on Material No.28.  As a result, it was decided that three supplementary sectional committees (tentative) would be established under the Working Group as a place for supplementary discussion of the issues which did not necessarily required discussion by the whole members.  (The general outline is as proposed in Material No.28).

The members left the official name and selection of members for the supplementary sectional committees (tentative) to the Chair.

 

2. Discussion on issues for reforming the Civil Code (law of obligations) (1)

Members discussed issues for reforming the Civil Code (law of obligations) based on Material No.27.  Concrete issues discussed are as follows.

1 General provisions on juridical acts

2 Mental capacity

    Among issues listed in Material No.27, “3 Manifestation of intention” will be discussed in the next meeting (the 31st Meeting scheduled on August 30, 2011).
