Summary of minutes

    Members discussed issues for reforming the Civil Code (law of obligations) based on Material No.32 (distributed at the 34th meeting) and No.37 (distributed at the 42nd meeting). Concrete issues discussed are as follows.

   1 “General rule on the standard time to calculate the amount of damages and the rule to calculate the amount of damages” (Material No.34, Part I, 1(4)).

   2 Among “Comparative negligence,” “Requirements” (Material No.34, Part I, 2(1)).

   3 “Profit and loss set-off” (Material No.34, Part I, 3).

   4 “Special provisions for monetary obligation,” (Material No.34, Part I, 4)

     (Above issue was left to this sectional meeting at the 38th Meeting of the Study Group.)

   5 “Effect of assignment which violates the special provision on the prohibition of claims assignment” (Material No.37, Part I, 1(3)(a))

   6 “Limitation of the effect of the special provision on the prohibition of claims assignment when the proposal of relative effect is to be adopted” (Material No.37, Part I, 1(3)(b)).
