1. Discussion on issues for reforming the Civil Code (law of obligations)

 　 Members discussed issues for reforming the Civil Code (law of obligations) based on Material No. 45. Concrete issues discussed are as follows.

  ・ Leases.

 

   Among issues for deliberation, the following issues were left to sectional meetings for supplementary discussion:

  ・ Perfection of lease rights (Material No.45, Part I, 3 (a)).

  ・ Automatic succession of lease contracts (Material No.45, Part I, 3(1)(b)(i)).

  ・ Agreement not to succeed the lease contract (Material No.45, Part I, 3(1)(b)(ii)).

  ・ Automatic succession of the obligation to return lease deposits (Material No.45, Part I, 3 (1)(b)(iii)).

  ・ Automatic reduction of the rent due to unavailability of the whole or a part of the subject matter (Material No. 45, Part I, 7 (2)(a)).

  ・ Cancellation due to impossibility to achieve the purpose of the lease (Material No. 45, Part I, 7(2)(b)).

 

2. Report

   The Chair reported that the issues which were decided to left to sectional meetings for supplementary discussion would be deliberated at the Third Sectional Meeting.
