Summary of minutes

1. Discussion on issues for reforming the Civil Code (law of obligations)

   Members discussed issues for reforming the Civil Code (law of obligations) based on Material No. 46 (distributed at the 55th meeting) and No.47. Concrete issues discussed are as follows.

  Mandate.

  General discussion on typical contracts which render services (employment, contracts to produce work, mandate, and deposits).

  Provisions in lieu of quasi-mandate for a contract which renders services.

 

   Among issues for deliberation, the following issues were left to sectional meetings for supplementary discussion:

  Duty to compensate a damage which the mandatary suffers (Material No.46, Part II, 2(2)).

  Claim for a fee when disposition of a mandated business is terminated in the middle (Material No.46, Part II, 3(4)).

  Claim for a fee when performance of rendering services becomes impossible (Material No. 47, Part I, 3).

 

2. Report

   The Chair reported that the issues which were decided to left to sectional meetings for supplementary discussion would be deliberated at the First Sectional Meeting.
