Medical Treatment and Supervision

Purpose of Medical Treatment and Supervision

 Medical Treatment and Supervision is a treatment system that aims to promote the reintegration of those who have committed serious cases such as murder or arson in a state of insanity or diminished capacity (a state where normal criminal responsibility does not exist owing to such reasons as lacking the ability to distinguish between right and wrong due to a mental disability).
 Based on the “Act on Medical Care and Treatment for Persons Who Have Caused Serious Cases Under the Condition of Insanity” established in 2003, in addition to creating a hearing procedure for determining appropriate treatment, those that were placed in in-patient treatment are given specialized medical care by designated medical institutions for hospitalization under the jurisdiction of the Ministry of Health, Labor and Welfare, and probation offices coordinate the social circumstances after discharge.
 In addition, those who were placed in out-patient treatment, besides being provided with treatment by designated medical institutions for routine visits under the jurisdiction of the Ministry of Health, Labor and Welfare, must in principle undergo mental health supervision by a probation office for three years, and any necessary medical care and assistance will be secured.
