State Litigation System and Its Role

Unified and centralized administration of state litigation

“Litigation” of disputes involving governmental functions consists of court proceedings such as filing complaints, claims and evidence. The Ministry of Justice performs such activities in a unified and centralized manner on behalf of the state, and this is called “the State Litigation System.” There are two types of disputes related to the interests of the state: civil disputes and administrative disputes. The specific cases related to these disputes are called state litigation cases, and the work related to their administration is called “litigation work.” In addition to the Litigation Bureau of the Ministry of Justice, state litigation work is also administered by the Litigation Department of the Legal Affairs Bureau and the District Legal Affairs Bureaus as local branch bureaus.

Securing the principle of law-based administration

The State Litigation System contributes to realizing and ensuring the principle of law-based administration of governmental functions by carrying out lawsuits related to the interests of the state in a unified and centralized manner, while ensuring proper harmonization between the interests of the nation and the rights and interests of individuals.

Prevention of disputes (Preventive Legal Support System)

The Litigation Bureau and the Litigation Departments also play a role in preventing disputes while contributing to appropriate solutions of legal issues by stating legal views or providing advice or cooperation with respect to inquiries from government ministries and agencies regarding legal issues that may develop into future disputes.
